1. Acceptance of Terms

By accessing, registering for, or using the DayGuide AI platform, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service. By clicking "Accept" during onboarding, you acknowledge that you have read, understood, and agreed to these Terms in full.

2. Subscriptions and Billing

DayGuide AI offers the following subscription plans:

Activities Plan — $15/month

For facilities focused on activities and engagement content. Includes 1 facility. Access to Dashboard, Activities, Chronicles, and related planning tools.

Family Essential Plan — $39/month

For families caring for a loved one at home. Includes 1 family account. Access to Daily Chronicles, Activities, Games, Menus, and Nova AI Assistant.

Starter Plan — $79/month

For small facilities getting started with AI activity planning. Includes 1 facility. Access to Chronicles, Activities, Games, Calendar, Menus, and Nova AI Assistant.

Professional Plan — $199/month

For single-location facilities. Includes 1 facility. Full access to all platform features including Design Studio, Analytics, and Programs.

Growth Plan — $599/month

Full platform access for growing multi-location organizations. Includes up to 3 facilities.

Scale Plan — $899/month

Full platform access for scaling networks. Includes up to 5 facilities.

Regional Plan — $1,499/month

Full platform access for regional networks. Includes up to 10 facilities.

Enterprise Plan — $2,499/month

Full platform access for large organizations. Includes up to 20 facilities.

Enterprise Plus — Custom Pricing (Contract Required)

Includes everything in Enterprise, plus a dedicated account manager, SLA guarantees, and on-site training and onboarding. Pricing is determined through a sales consultation. Access is granted only upon a signed contract and admin approval.

Subscriptions are billed monthly or annually and renew automatically unless canceled before the renewal date.
Annual plans are billed once per year at a discounted rate compared to monthly billing.
Each subscription includes a defined number of facilities or accounts based on the selected plan.
You are responsible for all charges associated with your selected plan.
Billing is processed securely by Stripe. DayGuide AI does not store full payment card numbers.
Pricing and plan structures may change with notice. Material price changes will be communicated no less than 30 days in advance.

3. Facility Limits and Access

Your subscription determines how many facilities or accounts you may create and manage within DayGuide AI:

Activities Plan: 1 facility maximum. Access to core activities and planning features only.
Family Essential Plan: 1 family account. Not intended for commercial facilities.
Starter Plan: 1 facility maximum. Access to core features only.
Professional Plan: 1 facility maximum. Full feature access.
Growth Plan: Up to 3 facilities included. Full feature access.
Scale Plan: Up to 5 facilities included. Full feature access.
Regional Plan: Up to 10 facilities included. Full feature access.
Enterprise Plan: Up to 20 facilities included. Full feature access.
Enterprise Plus: Custom contract pricing for 20+ facilities. Requires a signed agreement and admin approval before access is granted. Cancellation terms are governed by the individual contract.
Access and feature availability may be limited based on your subscription tier and facility count.
If your subscription lapses, existing facility data is preserved, but the ability to add new facilities is suspended until a plan is active.

4. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting support@dayguideai.com. Cancellations take effect at the end of the current billing period. DayGuide AI does not provide prorated refunds for partial billing periods unless required by applicable law. Your facility data is preserved after cancellation.

5. Use of Service

DayGuide AI is an activity planning and care engagement platform for senior care facilities. You agree to use the service only for its intended, lawful purpose. You agree not to:

Enter Protected Health Information (PHI) or sensitive medical data into the platform
Use the platform for any unlawful or fraudulent purpose
Attempt to reverse engineer or copy any part of the platform
Share account credentials with unauthorized users

6. AI-Generated Content

All AI-generated content must be reviewed and approved by qualified facility staff before use. DayGuide AI makes no guarantees regarding the accuracy or fitness of any generated content. You are solely responsible for reviewing and implementing AI-generated material.

7. No Medical Advice

DayGuide AI is not a medical, clinical, or healthcare record system. Nothing on the platform constitutes medical advice. Staff are solely responsible for applying professional judgment before implementing any AI-generated content with residents.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYGUIDE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. DAYGUIDE AI'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Changes to These Terms

DayGuide AI may update these Terms at any time. Material changes will be communicated via email and in-platform notice. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
